Court Dismisses Positive Light Suit

Dexter, MI, April 9, 2002 -- The United States District Court for the Northern District of California dismissed a suit filed by Positive Light, Inc. seeking a declaratory judgment of invalidity and non-infringement of a University of Michigan patent on the use of ultrafast lasers to ablate or change the physical structure of materials

Dexter, MI, April 9, 2002 -- The United States District Court for the Northern District of California dismissed a suit filed by Positive Light, Inc. seeking a declaratory judgment of invalidity and non-infringement of a University of Michigan patent on the use of ultrafast lasers to ablate or change the physical structure of materials.

"We are delighted that the court rendered this judgment in our favor" said Bill Clark, President and CEO of Clark-MXR, Inc.

US Patent 5,656,186 (and foreign counterparts) is an outgrowth of work performed in the Center for Ultrafast Optical Sciences at the University of Michigan. Clark-MXR, Inc. owns the exclusive rights in all fields-of-use other than human health and human cosmetic. The US Patent and Trademark Office recently reviewed the patent at the University's request and reissued it with an even broader set of claims.

Bill Clark went on to say "We consider this patent to be an important asset, and will not shy away from prosecuting it to the fullest extent possible under the law."

Clark-MXR, Inc. is a producer of ultrafast lasers and workstations for use in micromachining materials.
